☂️ Rain or Shine – Summer Fun at Foundation Communities

The rain last week may have taken the pool out of the equation, but not the PARTY!

This year we had to pivot last minute to turn our annual Land Sale TX/Foundation Communities Pool Party into a day of indoor fun complete with pizza, musical chairs, bingo and more! Each summer the students in the resident Summer Program at the Trails at the Park and Homestead Oaks properties gather at the Trail at the Park pool. With the pool closed due to weather and the onsite learning facility at the Trail at the Park community not being big enough to host the students from both resident programs at the same time, our team divided and conquered. With the help of the Foundation Communities staff, we threw identical indoor parties at both communities simultaneously. Our friends battled it out for McDonalds and Starbucks giftcards and other fun prizes. And, of course, frozen treats from Mom & Pops All Natural Frozen Pops were still the highlight of the day!

We look forward to making a splash again next year. But one thing is for sure – this event is a blast – rain or shine!

Breakfast Tacos for Veterans

Recently, our Land Sale TX team spent the morning volunteering at Patriots’ Hall in Dripping Springs for their weekly Taco Tuesday gathering, preparing and serving breakfast tacos to local Veterans and their families. While we normally deal with land stats like acreage, floodplain and setbacks, we were pretty proud to boast a different kind of stat: 100 breakfast tacos prepped, cooked, wrapped and served in under 1 hour!

We arrived early to cook in the fully stocked Patriots’ Hall kitchen to provide breakfast for the Veterans who gather there each Tuesday morning for coffee, conversation, and community. And, surprise – we snuck in trays of doughnut holes too for an extra boost!

Patriots’ Hall is a nonprofit organization on 10 acres dedicated to supporting over 70,000 Veterans and their families in the Central TX area through programs focused on wellness, connection, and long-term support. In addition to community events like Taco Tuesday, they offer peer support groups, transitional assistance, and resources designed to help Veterans build strong and connected lives after service.

We’re grateful for the opportunity to support an organization that does so much for Veterans in our community, and thankful to the Patriots’ Hall team for welcoming us into their kitchen and for all the wonderful conversations we had with those who have served.

This holiday season, giving back remains at the heart of who we are. We were honored to support several meaningful organizations and individuals who are doing important work in our community, and we’re grateful for the opportunity to help make the season a little brighter for others.

Foster Village Austin

We prepared and donated meal kits to Foster Village Austin, each complete with items for two full meals and grab-and-go snacks for children. Foster Village Austin supports children in foster care and the families who care for them by meeting practical needs and building a strong, connected community.

Stonebridge Health & Rehab – Dripping Springs

We were proud to participate in the Stonebridge Health & RehabResident Angel Tree Program, helping make Christmas brighter for senior residents and patients. By fulfilling curated wish lists, we were able to provide some of their favorite items and bring extra joy to residents during the holidays.

Foundation Communities – Home for the Holidays

This season, we sponsored Foundation Communities’ Home for the Holidays Program, which provides residents with financial support, groceries, household essentials, and holiday assistance during a time that can be especially challenging. The program helps ensure individuals and families living in Foundation Communities housing are able to experience stability, dignity, and a sense of celebration during the holidays.

Supporting a Family Displaced by the Sandy Creek Floods

We also assembled a meal kit, Christmas cheer basket, and sponsored holiday gifts for a family of four who were displaced by the Sandy Creek floods earlier this year. The mother of this family is also courageously battling cancer, and we were honored to support them during an incredibly challenging time.

Giving on Behalf of Our Clients & Partners

In lieu of traditional holiday gifts, we invited our clients and partners to share charities that matter to them so we could make contributions on their behalf. Submissions are supporting Foundation Communities, Central Texas Food Bank, and Texas Parks & WildlifeFoundation.

And while the holidays may be winding down, it’s not too late to give. Many nonprofits rely most heavily on end-of-year donations to continue their programs into the new year. Whether it’s a financial gift, volunteering time, or simply sharing their mission, even small acts of support can make a big impact.

These efforts reflect what matters most to us—showing up, supporting our neighbors, and leading with compassion when it matters most. We’re incredibly grateful to serve our community and to work alongside clients and partners who share these values.

4th Pool Party for Foundation Communities’ Students 💦

There are a lot of things we love about summer at Land Sale TX — longer days, sunshine, and the energy that comes with the season — but one event stands out every year as the highlight of it all: our annual pool party for the student residents in the Foundation Communities summer program! This summer we were thrilled to bring the tradition back again for the 4th edition, and it was everything we hoped it would be. From the moment everyone arrived, the pool was full of laughter, splashing, and the kind of joy that can only come from a day spent outside with friends. There’s just something about swimming together, playing in the water, and enjoying a carefree afternoon that makes summer feel like summer.

What makes this day possible is providing the lifeguards. This allows the students to safely take advantage of their complex’s pool as part of their summer program – something they are otherwise not able to do as a group – and we’re proud to support something that brings so much fun and connection to their summer experience.

Of course, no pool party is complete without food, and we kept things classic with hotdogs and chips to keep everyone fueled up between cannonballs and swim breaks. And, as always, the biggest hit of the day was cooling down with frozen treats from Mom & Pops All Natural Frozen Pops. Their pops are the perfect, all-natural way to beat the Texas heat, and we loved seeing everyone pick their favorites and enjoy something sweet and refreshing.

More than anything, what makes this day so special is the chance to create a fun, welcoming space for these students — a chance to relax, connect, and make memories together during the summer program. The fun, the squeals, the big smiles… it’s the kind of day that makes us grateful that doing what we do day to day gives us the opportunity to give back to our communities. We’re so grateful to everyone who helped make this year’s pool party such a success, and we already can’t wait to do it all again next summer. Until then, we’ll be holding onto the sunshine and the memories from one of the best days of Summer 2026!

Spring Break Meals for Children at The SAFE Alliance 🌭

SAFE provides education, childcare and housing programs to survivors of child abuse, sexual assault & exploitation, as well as, domestic violence.

When students are out of school, like for Spring Break, SAFE wants to ensure that the kids in their children’s program can still count on a quality lunch. They put out a call for volunteers to provide 30 meals each day of the Spring Break week to guarantee that their kiddos had the energy they needed for all the fun Spring Break activities they had planned at the center.

Land Sale TX was honored to participate and answered the call with hot dogs, fruit salad, fresh veggies with dip, chips and mini cupcakes.

Watch Out for That Tree! Do’s & Don’ts of Property Development When it Comes to Trees. 🌳

Trees have to be taken into consideration when developing property & there are steps that must be taken to ensure trees are protected and laws to enforce it. Where to find these regulations & what happens if they aren’t followed.

You may have heard of what’s called the Critical Root Zone or CRZ for short. So, this is an ordinance that is put in place by municipalities to protect trees. Now, Austin has a fairly strict tree ordinance and they have to protect the Critical Root Zone if you are developing any type of property around a tree. So, even if the tree is sitting in a certain spot, you can’t just start start digging up or placing a foundation or footings or a sidewalk or anything within 10 to 15ft, or even farther out of a tree. So, you need to work closely with the governing body. Typically, these are the municipalities and they even regulate their ETJ. Some local cities have also adopted tree ordinances such as San Marcus and Bastrop and many of these adjacent cities will actually model Austin’s tree ordinance.

So, the first thing you would need to do is actually conduct a tree survey to see if there are any protected heritage trees trees, as they’re commonly called. Generally speaking, a heritage tree is determined by whether it’s a certain size. So, they measure about 4 and a half ft. up from the ground level to measure the diameter of the tree. Or, if it has any type of historical significance, then it would probably need to be protected. Now, the critical root zone is determined by going out a foot, generally speaking, for every inch in diameter with a minimum of a 10t radius and that even extends upon that. Again, every city has different ordinances so you’ll want to work closely with them.

You know, for someone that’s in real estate, this could be frustrating because you may have a prime piece of property, but you have a large live oak heritage tree smack dab in the middle. But, that’s what makes Austin beautiful. It’s still a very green city and there are countless studies that have shown just being out in nature, being around trees, is beneficial.

So, how do we work around this, right? How do we work to preserve this? Now, some ordinances, some cities will allow you to pay a fee in lieu. If you cut down a tree, then you have to either pay a fee or maybe plant two more. The one thing you never want to do is just start cutting down a bunch of trees. There’s a local city close by that had a prime piece of land a developer bought and it was in the city’s jurisdiction and the developer went ahead and completely scraped the whole property without permission from the city. Now the city told me this in confidence, so I won’t name the specific city, but they slapped that developer with a $1.5 million fine. So, cities are taking this very seriously.

So, meet with the city, always disclose what you’re trying to do and then you’re going to have to get that tree survey and then determine which trees are protected and which are not. And, again, sometimes you can pay a fee in lieu and work with the city. So, it’s important that you know this information and, again, I think this is one of the factors that makes Austin so beautiful even though it is challenging from a real estate perspective.

2nd Annual Thanksgiving Feast Project Benefitting Hays CISD Student Families 🦃

Our 2nd Annual Thanksgiving Feast Gathering & Distribution is complete. We are thrilled to have been able to provide full-sized turkeys, potatoes, green beans, stuffing, rolls, gravy, cranberry, pumpkin pie, mini cupcakes, roasting pans and more to 25 families facing food insecurity in Hays County – enough for over 100 meals!

Like last year, we wanted to play a part in ensuring that families in our area facing challenging times didn’t feel the strain of providing Thanksgiving dinner for their families. And, we didn’t want to provide premade meals, because so much of what Thanksgiving is about is spending time and making memories with loved ones while preparing the turkey and staple side dishes that make up the traditional feast. That’s why these families received some items they would need to prepare like the turkey, dressing, gravy and potatoes.

This year a huge thanks goes to H-E-B (Kyle) for helping us pull together all the items & to Hays Hope To Go for connecting us to the Hays CISD student families in need.

We spent some time volunteering at HaysHope2Go this year organizing clothing donations and packing weekend bundles of food for student families and donating items on their “Most-Needed Items” list which they update regularly. So, we knew they would have a direct line to the families in the most need of this special meal during the holiday season. They made all the distribution arrangements and we loaded the cars.

HaysHope2Go is a project to alleviate hunger among our students who are most in need, as well as clothing and school supplies needs through their Hays CISD Clothes Closet. Food insecurity is a major barrier to having students focus on their work in class on their way to reaching their full academic potential. And, of course, being outfitted with good quality, seasonal appropriate clothing is essential to a child’s confidence and well-being. Families are even able to schedule time to go and pick out clothing for their families which is all arranges, organized and displayed nicely and with dignity.

With the community’s support and generosity, volunteers, and amazing community partners, they take on poverty and hunger for the benefit of the children in the Hays CISD district. They are located right on campus, so it’s easy access for student families and they work directly with the school counselors who discreetly notify them when they’ve discovered that a child may have food and clothing needs or other assistance. This year they have helped around 9,000 people and provided almost 122,000 meals. They are located right on campus, so it’s easy access for student families.

We look forward to our continued work with this wonderful and vital organization.

Is There Any Way Around Floodplain if Your Looking to Build On or Develop Property?

What are CLOMRs and LONRs? So, CLOMRs and LONRs are regulatory documents that are issued by the Federal Emergency Management agency, also known as FEMA for short, as it relates to the floodplain. So, CLOMRs and LOMRs are documents that you can get from FEMA and also approved by the Army Corps of Engineers if you are looking to build or build in the floodplain or actually alter the floodplain through cut and fill, altering a body of water, a river, a stream, etc.

CLOMR stands for conditional letter of map revision and LONR simply stands for letter of map revision. So, if you as a homeowner or a builder are looking to build a structure in the floodplain, then you would get a CLOMR, a conditional letter of map revision showing that you are not adversely affecting adjacent property owners because of the water flow coming through. So, for example, if you build a home or a commercial building in the floodplain, water is going to run into that in the event of a flood and it could increase the size of the floodplain, affecting adversely neighboring properties. Let’s say you’re looking to actually alter the land through cut and fill. If you’re going to add a bunch of dirt, for example, to build out of the floodplain, if you’re going to alter a body of water, then you would need to get a letter of map revision. Now, keep in mind, you’re going to have to work with licensed surveyors, professional engineers, you’re going to have to work with FEMA and also get it approved by the Army Corps of Engineers. Obviously, these are federal government agencies.

This is a marathon not a sprint, minimum time frame you’re looking at probably 12 to 24 months. So, if you have it under contract with your land owner, you have to be upfront with them and you need to understand that this is going to take a long time. If you purchase the property, again this is a marathon not a sprint, but it can be very advantageous to you. I know a local developer who bought a piece of land and it was primarily in the floodplain, but over the years they allowed people to dump dirt from excavation sites locally, construction sites, with the one caveat that the dirt was not contaminated. And, then they slowly built that land up and then worked to get a letter of map revision from FEMA and the Army Corps of Engineers. Because they were able to do that, they then sold that property, because most of it was now out of the floodplain, and they netted over $3 million.

So, it can be very advantageous, but it’s not as simple as just dumping a bunch of dirt. You have to work closely with FEMA and the Army Corps of Engineers. It can be a very advantageous tool. Again, it is a long time frame and you need to work with professionals, so make sure that you’re talking to the right people.

Could Fire Flow Requirements Halt Your Real Estate Development in Central Texas? 🔥

What considerations and requirements are there when it comes to fire flow and your property development? Who sets these standards, why they’re important & what they could cost you.

If you’re looking to develop some land or a commercial building, especially in the city’s jurisdiction and sometimes even in the ETJ, you may have heard of fire flow requirements. So fire flow is the amount of water that firefighters need in the event that there’s a fire in a building or in a development. Typically fire flow is expressed as 1,000 gallons per minute that is flowing through a water line and this is determined by fire codes, also building codes, but typically local fire department, generally speaking, it’s 1,000 gallons per minute.

So, what does this mean for your development? Well, generally speaking, you have to have at least an 8 inch water line to support fire flow. Some local cities like Bastrop only requires a 6 inch waterline. Generally speaking, counties do not require fire flow, but there is a push to get Bastrop county, for example, to start requiring fire flow even in the county’s jurisdiction. The reason being is Bastrop is very prone to fires. Bastrop has had some fires that have decimated the area in the last 10 to 15 years because of all the undergrowth, the yaupon and a lot of pine trees.

The implications for you as a real estate investor, a real estate developer, could be millions of dollars. Because, if you have to upsize that water line, for example, from a 2 inch to an 8 inch water line and if you have to drag that waterline several thousand feet, we’re talking you know seven, easily seven figures sometimes. I mean we’ve gotten a a water feasibility study that said we are going to have to upsize the water line and it was going to be about $1.7 million.

It’s imperative that you are talking and engaging these governing bodies, be it the municipalities or the counties, before you move forward with your development. You need to tell them what you’re looking to develop and then you’ll have to submit a water feasibility study. But, fire flow is very important and sometimes lenders will even require it because, obviously, they want to protect the asset when they are lending on that asset. So, again, fire flow is is generally 1,000 gallons per minute. But, every city and every city and or county may have different rules in place. So, it’s important that you are engaging these governing bodies.

What Tax Provision Could Save You Thousands When Selling Inherited Land?

Those that inherit land (or their agents) many not be privy to this tax provision that helps to mitigate capital gains taxes when they choose to sell. But, a Step-Up in Basis can save thousands on inherited property – learn how:

If you’re working with a family that just inherited some land or a piece of real estate or if you just did yourself, you may have heard of what’s called a step-up in basis. So, a step up and basis is a tax provision that allows the basis of the property for tax purposes to be adjusted to the fair market value at the time of the original owner’s death, rather than the basis of what they paid for it when they purchased the property. So, this can be a tremendous tool to help save on capital gains taxes if the heirs ever go to sell the property.

So, how it works, for example, let’s say a father or a mother purchased a piece of land for five hundred thousand dollars. When they pass away, their heirs, their children, inherit that property. The fair market value of that property we could say is a million dollars, so their adjusted basis would actually go up to a million dollars. So, if they were to sell the property six months down the road for 1.2 million, they would only have to pay capital gains tax for two hundred thousand dollars in value because the difference of 1 million to 1.2 million, as opposed to paying the difference of five hundred thousand dollars, which is what their parents paid for it and the sales price of 1.2 million. Now, they don’t have to pay capital gains tax until they actually sell the property. However, they may be subjected to estate tax.

So, it all depends on how many assets they get and for example. So, always, always work with a qualified CPA. I say this in every video, as well as, a good real estate attorney. But, this can be a tremendous tool because it helps to, you know, not eliminate taxes, but to mitigate taxes as much as possible. And, then you can also do 1031 deferred exchanges, which we’ve discussed as well. But, this can be a great tool.

And, especially if you’re working with a family. Of course, you know going through the death of a loved one is never easy, so if they’re trying to dispose of the assets, you know, as a real estate agent or broker you cannot legally practice law, but you can guide them to a qualified CPA or real estate attorney. But, you will be considered an expert if you can talk to this intelligently, because we’ve been surprised how many families don’t know about this. So, it’s called a step-up in tax basis and it can be extremely beneficial in mitigating capital gains tax as much as possible.
