A quick way to determine whether an oil & gas pipeline is no longer being used and/or is abandoned. And, what vacating an easement could do to the value of your property.

If you own a piece of land or you’re looking to buy a piece of land, more than likely there will be easements on the property. But, did you know, in some cases, you can actually remove an easement? This process is called vacating an easement.

In Texas, many oil and gas pipelines were laid several years ago, obviously oil and gas is big business in Texas. The Texas Railroad Commission has a great website where you can view many of the pipelines that are laid throughout Texas and you can actually see if some of these pipelines have been abandoned. Now, one note here. Non-use does not necessarily mean that the pipeline has been abandoned. But, once you go to the Texas Railroad Commission website, if you see that a pipeline has been abandoned, you can actually reach out to the company that the easement was granted to to see if they will abandon that easement and remove it entirely because it is no longer in use and they have abandoned that.

Of course, this topic is very, very nuanced. So, we highly recommend that you work with an attorney to vacate an easement. I promise you they will be worth every penny. I promise you that.

Of course, once an easement has been indefinitely removed from a property that value of the property could increase substantially because it is no longer encumbered by that easement.
