There’s an easy way to find out whether the property you are looking to buy or sell is located in the city, ETJ or county only jurisdiction. There can be implications of not knowing if it lies in more than one.

Whenever you’re buying a piece of property, it’s very important to understand in which jurisdiction the property lies. Is it in the city’s jurisdiction, which is going to come with some pros and cons, which we’ll discuss? Is it in the ETJ, which stands for extra territorial jurisdiction? Or, is it in the county only? If it’s in the county only there is no zoning. There is also no zoningΒ  if it lies in the ETJ.

However, if you’re in the city’s jurisdiction, there’s going to be more restrictions on what you can build. There’s going to be zoning, there are going to be required setback lines, things of that nature. So, it’s really important that you look out for this.

We actually got a piece of property under contract and it’s in Bastrop county but, funny enough, it’s in the Austin two mile ETJ. So, therefore, we actually have to work with Austin now, as well as, Bastrop county when subdividing this property. So, it definitely threw a curveball that we weren’t expecting.

There are websites that you can find and the simplest way to find this is just to type in, for example, if a property is in Bastrop all you have to do in google is type in “Bastrop ETJ map” and almost every municipality and county will have maps online that you can find out in which jurisdiction these properties lie.

Believe it or not, real estate agents make this mistake all the time on their listings. When they list properties, they don’t take that extra step just to verify and that’s a potential lawsuit waiting to happen. So, always do your homework. It’s easy to find these maps and websites online.
